5. Restricted Bequests

If you are considering a bequest and want to ensure your gift supports a specific area of campus, please contact us. We are happy to collaborate with you and your attorney to explore giving options that align with your philanthropic goals. We can also help craft language that clearly reflects your intentions and ensure appropriate documentation is in place to properly steward your gift once it is received.

If you are planning a restricted bequest, we recommend including the following provision to allow Utah Valley University flexibility in the future, should it become impossible to use your gift exactly as intended:

Although Utah Valley University Foundation Inc. anticipates all gifts to be used according to the Donors' intent, if it becomes impossible or impractical to satisfy the original intent of this agreement, an alternative application for the Fund consistent with the wishes of the Donor(s) shall be determined by the Foundation. For this reason, Utah Valley University Foundation Inc. reserves the right in such a case to modify the terms of the gift so that the funds may be used in a manner which closely resembles the Donors' intent and keeps the name of the Donor(s), if appropriate, associated with the gift. The Donor(s) and Utah Valley University Foundation Inc. acknowledge that the gift principal or corpus of the pledge payment(s) or any income thereon are irrevocable and may not be transferred or revert to the Donor(s), to their heirs or successors, or to assigns of the Donor(s).
